NC Court of Appeals publishes opinion regarding counterclaims in District Court

In an opinion published August 5, 2014, the NC Court of Appeals recently held that counterclaims in District Court may not exceed the jurisdictional limit of the court, which is currently $10,000. Therefore, parties in District Court actions who wish to pursue such claims must either: (1) assert their claims on appeal to the District Court from an adverse decision by the magistrate or (2) assert those claims in an entirely separate action.
